These Terms of Service (“Terms”) govern your use of the services provided by Ungo SAS (“we”, “us”, “our”), operating the Ungo platform at ungo.app and its subdomains (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Who can use Ungo

You must be at least 16 years old, or the minimum age required in your country to consent to data processing. You must provide accurate information and keep your account credentials secure.

2. Your content

You retain all rights to the content you publish on Ungo. By uploading, you grant us a limited, non-exclusive license to store, process, and serve that content as necessary to operate the Service.

You are solely responsible for your content. You must not publish content that:

• Infringes third-party intellectual property rights.
• Is illegal, defamatory, or promotes violence.
• Contains malware or attempts to compromise other users or our infrastructure.
• Violates applicable law in your jurisdiction or the jurisdiction of your readers.

3. Acceptable use

You agree not to:

• Use the Service to send unsolicited commercial email (spam).
• Reverse engineer, scrape, or attempt to disrupt the Service.
• Resell Ungo accounts without an Agency plan (which explicitly permits sub-accounts).
• Circumvent usage limits imposed by your plan.

4. Plans, billing, and refunds

Paid plans renew automatically at the end of each billing period. You can cancel any time from your account settings; your plan continues until the end of the current period, after which your workspace reverts to Free tier limits.

We offer a 14-day refund window for first-time paid subscriptions if you contact support within that window.

5. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Published sites are served from Cloudflare’s global edge; the editor and dashboard may have scheduled maintenance windows.

6. Termination

We may suspend or terminate accounts that violate these Terms, with or without notice in cases of abuse. You may terminate at any time by deleting your account; we will delete your data per our Privacy Policy.

7. Disclaimer of warranties

The Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be error-free or uninterrupted.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service is limited to the fees you paid us in the twelve months preceding the claim.

9. Changes

We may update these Terms from time to time. Material changes will be announced by email to the address on your account at least 14 days before they take effect.

10. Governing law

These Terms are governed by the laws of France (Tribunal de commerce de Paris), excluding its conflict-of-law rules. Disputes will be resolved in the courts of France (Tribunal de commerce de Paris).
